Walmart Assistant Manager Files Unpaid Overtime Class Action Lawsuit

- by

Overbrook, PA: A potential unpaid overtime class action lawsuit has been filed by a former assistant manager against a Walmart store in Overbrook alleging the retailer repeatedly violated the Fair Labor Standards Act by classifying assistant managers as exempt employees.

Specifically, the employment lawsuit claims that the duties performed by assistant managers at Walmart make them nonexempt, hourly workers, entitling them to overtime pay. The plaintiff further claims that he frequently worked between 50 and 55 hours a week. Estimates suggest that the class could exceed 1,000 plaintiffs, given the number of Walmart stores, supercenters, discount stores and Sams Clubs in Pennsylvania. The lawsuit states each retail unit employs between 8-10 assistant managers.

The plaintiff is seeking, on behalf of the class, overtime pay, penalties and interest.
