U.S. government, Department of Health and Human Services and the Food and Drug Administration

Class action status is being sought in a lawsuit filed against the U.S. government, Department of Health and Human Services and the Food and Drug Administration in regards to the reimportation of medications from Canada. The suit alleges that the government is unconstitutionally prohibiting the plaintiffs from purchasing drugs available at lower prices in Canada in the United States through the use of federal laws and regulations.

The suit seeks to compel the government to allow states, cities and individuals to import prescription drugs from Canada. The suit also alleges that the plaintiffs' right to privacy is being violated by the government. Illinois Gov. Rod Blagojevich, who supports the case, said of the plaintiffs, "They are asking for one thing and one thing only: to make their own rational medical decisions and the right to buy the safe, affordable prescription drugs they need without the interference of the government."
