Landry's Restaurants Inc.



A class action lawsuit has been filed against Landry's Restaurants Inc. on behalf of servers at restaurants owned by Landry's. The suit was filed in regards to the company's practice of deducting credit-card fees from servers' tips, which the suit alleges is an illegal deduction under the Fair Labor Standards Act, which reads, in part: "Whether a tip is to be given, and its amount, are matters determined solely by the customer, and generally he has the right to determine who shall be the recipient. Only tips actually received by an employee as money belonging to him which he may use as he chooses free of any control by the employer, may be counted in determining whether he is a 'tipped employee'."
