Staples Inc.



A class action lawsuit has been filed against the office supply company for allegedly failing to pay employee overtime. The lawsuit was filed in Massachusetts District Court and claims Staples headquarters' employees regularly worked in excess of 40 hours a week, but failed to earn overtime, in violation of federal and state labor laws.

Employees allege they have no management duties and work on fixed rates plus commissions, regardless of the number of hours they work. To be exempt from overtime pay, Staples headquarters employees must be paid more than $455 per week on a salary or fee basis; their primary duties must be office or non-manual work directly related to the management or general business operations of Staples or its customers; and their primary duties must include the exercise of discretion and independent judgment with respect to matters of significance. The class action claims some employees do not meet these specifications and should therefore be paid overtime.
