$1.75M Settlement Proposed in Medela Breastmilk Class Action Lawsuit


This is a settlement for the lawsuit.

New York, NY: Medela Inc, the manufacturer of Medela Breastmilk Freezing & Storage Pack, the Medela Breastmilk Feeding Gift Set, the Medela Breastmilk Storage Solution, and other related products, has reached a preliminary settlement in a consumer fraud class action.

The lawsuit, entitled Baghdasarian, et al. v. Medela Inc., et al. alleges Medela Inc, made false statements concerning its its 2.7 oz/80 mL, 5 oz/150 mL, and 8 oz/250 mL breast milk bottles and/or component parts, including that the bottles were safe to freeze small quantities of breast milk in. The lawsuit claims that freezing makes the lids on the Medela bottles brittle, which can result in their breaking or shattering if dropped, thereby ruining the breast milk within the bottle. The lawsuit contends that Medela failed to disclose the bottle lid defect.

The proposed $1.75 million settlement would resolve these allegations. If approved, eligible class members would receive a $2 discount certificate per bottle purchased during the Class Period, July 1, 2008, and March 20, 2013, with no more than five discount certificates allowed per class member. Qualifying Class Members can receive up to $10 in discount certificates if they file a valid Claim Form by the June 25, 2013 deadline.

In addition to the monetary relief described above, Medela has agreed to make certain changes to the packaging of the Bottles and its website, as more fully described in the Settlement Agreement on file with the Court. A final fairness hearing is scheduled for September 25, 2013.

Medela did not bill the insurance in a timely manner so I ended up having to pay for the pump. Caution to anyone considering making a purchase from medela.

I received a Medals double electrical breast pump from Wic in September. My supply on My right breast began to slowly decrease. I didn't know why. Recently my motor went out, so I took apart the front plastic cover of the motor and saw the suction bulb was knotted in. Can anything be done about this?
