$69M Volkswagen Leaky Sunroof Class Action Settlement Approved

- by

New York, NY: A $69 million settlement has been approved ending a class action lawsuit against Volkswagen and Audi alleging the vehicles had defective sunroofs that leaked. The settlement has been in the works for some time but was finally approved this week by the US Court of Appeals for the Third Circuit.

The settlement is for Dewey v. Volkswagen. It was originally reached in 2010 but was remanded because it divided class members and gave priority access to an $8 million settlement fund to owners of certain models.

I have a 2019 VW Tiguan that was serviced 8/21/2021 after I noticed the driver carpet damped in water, I live in south Texas and the 100+ degree weather did not help the odor that was coming from that wet carpet. Took into dealership and mentioned it was a clog/leak that was coming from the sunroof. The entire carpet interior were replaced along with the “leak” fixed. Fast forward 1 year and here I am again with the same issue. Now my car is out of warranty!

Hello,
I have a 2016 vw Jetta that has a sunroof that has leaked and now is stuck open. The dealership wants to charge me $4k to fix it. I’ve seen all the class action law suits and was wondering if this is something I could sue for.

Thanks

Good morning Mr. Wissler,
I wanted to reach out to you about my VW Jetta SportWagen that recently had water damage due to a gasket issue with the panoramic roof. I want to start by saying how happy I have been with the service department at VW of Rochester as they have made every effort to accommodate my needs even though you have been exceptionally busy this fall. Historically speaking, your department has been second to none with the needs I have had over the course of the 2 years that I have owned this vehicle. However, the more I consider the current issue with the car, the more I feel compelled to voice my displeasure with the situation that I find myself in. If I had known that there were leak issues with this model's panoramic roof I would certainly have bought a car cover on day one, as my neurosis associated with upkeep and maintenance of my purchases is probably close to diagnosable. In addition, I had brought the car in due to a noticed leak about six months ago and I was told that the issue was taken care of. In my research online I found that there was a class action lawsuit associated with the VW panoramic roofs leaking and because of that, VW now puts information about recommended cleaning the roof gasket every 2 years or 40,000 miles in the owner's manual. While I have to take ownership for not reading the manual front to back, I feel that this is a major concern for me for two reasons, 1. Neither at the time of purchase nor at the time the moon roof was cleaned less than 6 months ago, was I informed of the need to clean the gasket every so often as a means of leak prevention, and 2. This gasket was cleaned by your service personnel less than 6 months ago (and far less than 40,000 miles ago), indicating that this issue should have been resolved for at least another year and a half.
I find this  lack of information to be especially difficult to accept, given that I am now in the position of paying $1600.00 for replacing electric components and drying out a waterlogged vehicle. To add insult to injury, the towing company ended up breaking my side view mirror when helping me move the car into towing position in a torrential rainstorm last saturday night. (While I know that this is not your fault, it has certainly added to my headache associated with what I would consider a completely avoidable situation.) I really love this car, to the point where I often find parking spots that ensure minimal risk of other car doors hitting mine, so my biggest concern now is that I'll have a car that no longer functions how I expect it to and will be plagued with nuanced issues relating to this water damage incident in the coming years. I'm sure you can understand my frustration.
I was informed by Steve Barenger that if this issue had occurred in August of this year I would still have been under warranty and I'm wondering if there is something you can do to help me come to terms with what I see as a rather unfair and certainly avoidable predicament. Especially considering that I brought this issue up with a previous leak in the recent past.
If you would like to discuss any of this over the phone my contact info is below.
I'm sorry for the direct tone of this email but I have some serious concerns with how things have been handled regarding a known issue with this model and I hope we can come to some reasonable solution.
Thank you for your time,

2017 GT! SE Autobahn: sunroof leaked in PHOENIX AZ. Warranty still in effect _BUT_ the VW Dealer in Mesa AZ only cleaned drain holes and taped over suspected leak areas. CARPET was soaked, as was the two instrument / control panels (up top and below, surrounding shift lever).
Got GTI back in 3 days, now girlfriend has alerted me to "funny"/ "musty" smell in passenger compartment. Is this Lawsuit still current? (March 2020)

Hello I bought my VW golf Sportswagon TDI with panoramic sunroof brand new and 2017. It was left over from the TDI recall situation and when I bought it and had 300 miles on it. Since then I have had the sunroof leak three times. This was the third and final time as of October 2019 and they stated that this would be the last time they would fix it and the other times would be up to me to make sure maintenance is done yearly. With this issue there has been a door that’s become rusty at the hinge and potentially Bluetooth damage As well as a rusted hinge on the passenger side door that squeaks really badly due to water running down it.

Any help in the matter would be just and would appreciate how to proceed in future issues when they occur.

Kind regards,

Kim Baumgartner
