$9.5M Settlement Reached in Lowe's Managers' Unpaid Overtime Class Action Lawsuit


This is a settlement for the Employment lawsuit.

Los Angeles, CA: A $9.5 million settlement has been reached in an unpaid overtime class action pending against Lowe' Home Centers Inc. The lawsuit was brought by the big box DYI store' human resources managers' who alleged they were misclassified as being exempt from overtime

Filed in August 2012, the lawsuit alleged that Lowe' classified its human resources managers as exempt from the Fair Labor Standards Act (FLSA) overtime requirements, but that their duties were not as sophisticated as their title suggested and they should not be classified as exempt.

Lead plaintiff Lizeth Lytle and fellow class members allege that although they were given "manager"titles, the 1,745 "managers"in fact lacked the authority to make meaningful decisions and did not supervise employees.

The settlement fund includes up to $3.2 million in legal fees, with class members dividing the remaining fund amount between them. The method for the proportional allocation has not yet been determined, according to the settlement.
