Auto Price Finder Spam Text Message Class Action Settlement Reached


This is a settlement for the Media/Telecom lawsuit.

Chicago, IL: A notification program is underway, as ordered by the Circuit Court of Cook County, Illinois (the "Court"), to alert those who received an unsolicited text message advertisement , in violation of the Telephone Consumer Protection Act (TCPA), regarding car price quotes about a proposed class action settlement that may affect their rights.

This lawsuit claims that the defendants sent SMS text message advertisements containing web addresses or links leading, directly or indirectly, to www.Auto-Price-Finder.com without receiving prior express consent to do so. The defendants deny the claims and allegations in the lawsuit. The Court did not decide in favor of plaintiffs or defendants. Instead, the parties have agreed to settle the lawsuit to avoid the uncertainties and expenses associated with ongoing litigation.

The Settlement Class includes any person who lives in the United States or its territories and received a text message that contained a web address or link leading, directly or indirectly, to www.Auto-Price-Finder.com, and who did not agree to receive such a message. The text messages involved in the settlement advertised car price quotes and other information regarding automobiles, and may have contained web addresses or links. Class Members may be eligible to receive a cash payment from the Settlement Fund being established as part of the Settlement. Class Members may be able to receive up to $100, regardless of the number of text messages they received, if they submit a valid claim, under penalty of perjury, and can provide sufficient documentary verification (such as a telephone bill) that they received an applicable text message. If Class Members submit a valid claim, under penalty of perjury, but cannot provide sufficient documentary verification, they may be able to receive up to $15, regardless of the number of text messages they received.

Notices are being e-mailed or mailed to known potential Class Members and are scheduled to appear across the country via online and mobile banner advertisements and in a national newspaper leading up to a hearing on November 4, 2013 at 9:30 a.m., when the Court will consider whether to grant final approval to the settlement. The Court has appointed Jay Edelson, Christopher L. Dore, and Benjamin H. Richman of Edelson LLC, and Daniel J. Marovitch of the Marovitch Law Firm, LLC as Co-Lead Class Counsel to represent the Settlement Class. Those affected by this settlement can submit a claim for benefits or they can ask to be excluded from, or object to, the settlement and its terms. The deadline for exclusions and objections is October 21, 2013. The deadline to submit a Claim Form is November 11, 2013.

A toll-free number, 1-877-264-9634, has been established in the case known as Woodman, et al. v ADP Dealer Services, Inc., et al., Case No. 2013 CH 10169 (Cir. Ct. Cook County, Ill.), along with the website, www.AutoTextSettlement.com, where the notice, claim form, settlement agreement and other documents may be obtained.
