A $300 million settlement has been reached in the class action lawsuit filed on behalf of all persons or entities who purchased the company's common stock between October 19, 1999 and March 10, 2003. The hearing to determine whether the proposed settlement should be approved by the Court as fair, reasonable and adequate will be held on November 9, 2004 in New York.
