Cocoa and Rice Krispies False Advertising Lawsuit Settled

New York, NY: A settlement has been reached in the class action brought against Kellogg's regarding claims the company made concerning it's breakfast cereals - Cocoa Krispies and rice Krispies. According to the suit, Kellogg's alluded to improved immune function associated with eating the cereal.

If you purchased Kellogg's Rice Krispies Cereal or Cocoa Krispies Cereal between June 1, 2009 and March 1, 2010, you may be entitled to a cash refund from a class action settlement. The settlement is for $2.5 million and class members can make a claim up to November 16 2011.

The settlement resolves a lawsuit over whether Kellogg Company falsely advertised that Rice Krispies cereal and Cocoa Krispies cereal supported a person's immunity system despite not having competent clinical evidence to support the claim. Kellogg stands by its advertising and denies it did anything wrong. The Court did not decide who was right. The Court has scheduled a Final Approval Hearing for August 29, 2011.
