Atlas Chalet Shingles Defective Products Class Action Lawsuit Filed

New York, NY: A defective products class action lawsuit has been filed against Atlas Roofing Corporation alleging Atlas Chalet Shingles are defective and fail to comply with the manufacturer' claims (0:13-cv-01505-TLW).

Filed on June 3, 2013 in the US District Court for the District of South Carolina, Rockhill Division, on behalf of a South Carolina couple and all others who are similarly situated, the lawsuit alleges Atlas marketed its Chalet Shingles as being durable, reliable, and compliant with ASTM standards appropriate for use in homes and other structures.

The lawsuit claims the shingles did not perform as marketed. Allegedly, Atlas also told Plaintiffs that the products would be free of defects for at least 30 years, and that it would remedy the situation if the shingles failed to live up to these standards. The lawsuit alleges that Atlas knew its Shingles were defective, causing, blistering, granule loss, increased moisture absorption, and reduced life expectancy.

Allegedly, the Shingles are so defective that Plaintiffs in the class have to repair or replace the Shingles sooner than reasonably expected. According to the Complaint, the products fail to satisfy industry standards. Therefore, the suit alleges, the Chalet Shingles have not lived up to Atlas' representations and warranties, and consumers are entitled to compensation.

According to the Complaint, this class action asserts breach of express warranty, breach of implied warranty, three counts of negligence (negligence, gross negligence, and negligent design), strict products liability and fraudulent concealment.
