A suit has been filed against Robert W. Baird & Co. Inc. alleging violations of the Fair Labor Standards Act.

Carmela Heinl alleges Baird, treated her like an hourly employee, but didn't pay her for overtime hours when she worked more than 40 hours a week. She is seeking payment for those overtime hours and damages.

Heinl says in the lawsuit she was "on rare occasions" paid for overtime, but that Baird "routinely failed and refused upon demand" to pay her for the overtime hours. She also says some Baird brokers had "side-deals" and "under-the-table" arrangements with their sales assistants, and that Baird "had knowledge of and/or impliedly (sic) consented" to such arrangements.

"It's my understanding that this is going on with current employees who aren't saying anything because they have their jobs to protect," lawyer Bronsnick said. "It's about time that Baird faces their legal obligation under the Fair Labor Standards Act."
