Clayton Homes Inc., CHM Homes Inc. alleging Undisclosed Wheels and Axles Charges



Clayton Homes, builder, seller, financer, lessor and insurer of manufactured and modular homes, is facing a class action that accuses it of charging for wheels and axles, while not disclosing this to the purchaser.

Apparently Clayton Homes tells the purchasers they are not buying the wheels and axles, then takes the wheels and axles and resells them for additional profit. The lawsuit is seeking $2,200 for each class member.

Is there an open Class action lawsuit in the state of Texas? I am currently in the middle of a personal lawsuit with Clayton homes for damages. I have noticed alot of items that need attention and repaired. I just bought this last week and it is already falling apart.

My husband and myself purchased a Clayton Mobile Home through Vanderbilt in 1998. 4 yrs after the purchase our neighbor who also purchased a mobile home through Clayton (same dealership) in Lafayette, La. was removing there furniture into the yard and had a sign that read quarantining. I ask what was that about and he replied " his children and his wife had been sick for about a year with sinuses, Bronchitis, all kind of lung issues etc. He called CDC and they sent test kits for h to lay out and 3 weeks later someone showed up and said the trailer was unfit to live in that black mold was present. This was a serious danger to his family. Said that all beds, furniture, anything that couldn't fit in a washer had to be hauled off. " He then had someone come out who determined that the mobile home didn't have a moisture barrier which caused the black mold and other molds to grow. He found out there was a class action suit against Clayton for thos and filed. He also left his trailer for Clayton to repossess and gave me the person to call. My husband removed a piece of our siding and sure enough covered in mold ! We completely had to rebuild every wall in our mobile home costing a small fortune. We filed with the class action suit and here we are 24 yrs later and not a word from anyone. Also there is no insulation between the a/c ventilation and the floor which caused all floors along the ventilation system to rot. Tram built in a/c unit lasted 10 yrs and failed. The company went out of business. Don't purchase a mobile home without checking for the moisture barrier. For what we have had to repair and fix we could have purchased a 3 Br brick home. I wouldn't buy a Clayton Mobile home through Vanderbilt they even kept my axles and tires. MAD IN MORGAN CITY !!!!

I purchased a New double wide Clayton home November 2021. When they were delivery it the two pieces did not fit together , Looked like they put a stud on the wrong side and set the whole alignment off. The kitchen windows are off center and the stove hood nothing lines up. the floors have rocks under them and have rips in the lanolin. The cabinets are so cheap they only put one screw in the draw brackets so of course the draws broke in one month . The side door was off and a stray dog pushed it in while I was at work because it was not latching right. The ceilings are a mess with cracks and poor touch ups. everything is poor quality. Lots of other issues too many to list. I have only been in it for 6 months and its already falling apart. I have had 3 of them out to look at it but nothing has been fixed yet. Really not sure if this place will last 10 years.I really don't think these Homes are worth more than 35000 tops not 100,000 to 200,000 poorest quality. There like live in it 5 years, then throw away homes because you will have to replace everything after 5 years.

We need help filing a lawsuit against Clayton Homes in NY! Our house is a little over year old and it is falling apart. My house was delivered soak and wet and mold is everywhere. They have been aware sine we found it last April!!! They sold me things that they didn’t provide. Do not buy a Clayton home ever!

I bought a new home from them for $160k. When we were buying it we noticed water spots on the ceiling which they assured me was just from not being set up properly on the lot and agreed to repair. We put that in the purchase contact. They’ve been out over 5 times in the past couple of years and it’s still not fixed. They never replace the insulation that was water damaged in previous repairs and it’s always extremely cold on one side of the house. We currently have water leaking into our master bath and bedroom. We’ve also had tons of electrical problems and are now fearing that mold is becoming a health risk. We need help.

We bought our 2017 Lula mae in Oct of 2017 and have issues every since. They didnt even come back to finish it out until April 2018. Doors not staying open . roof leaking, glass around shower leaking water and all of the lights in our bathroom hallway and dining room went out. After calling an electrician find out that the 2 switches he checked have loose wires that arched causing them to blow. He said he is. Shocked that our house has not caught fire. He will be back after Christmas to check the rest. But as of now the main breaker has been cut off and we can't even live in our 2 year old home

We too bought a home from Clayton, Giles home, the Game Changer model, in July 2011. We are having the same issues..We have had nothing but problems out of it. We will have to remodel this home in less than 5 years and we are paying for it for another 10 years. It is ridiculous! The home is not level and doors do not shut properly, we complained to the dealer, Clayton Homes in Pelham, Al, but they never did anything. Within 6 months two of our bathroom faucets popped off causing water to go everywhere. The wall cabinet in the master bath had to be replaced, which they did replace but never fixed the big spot on the ceiling but they never came to check on the 2nd bath when it happened. Neither tub is caulked at the floor and we have to keep a towel down to catch excess water and I am scared of what the damage is gonna be like when we have to fix it. Also within 6 months the staples in our den carpet started coming up and we had to just pull them all up because we were stepping on them, this is the cheapest carpet I have ever seen. In the first year The vinyl in the kitchen had spots where the nails for the sub flooring was coming through and had cuts in them from everyday use. My kitchen cabinets are that cheap pressboard and have all swollen up and are peeling from normal spills. When it was delivered there was cracked walls in every room that they had to replace and the island in the kitchen was out of square And they never fixed it properly, just tried to cover it up. The overall design of the this home is very poor, there should have been more thought in the placement of the dishwasher and refrigerators. The furnace blows a contractor every winter and we have to replace it. The laundry room is a joke, not near big enough and again poor design, the laundry room door and the outside door open into each other and is a real pain to use and the location of the dryer vent cause the dryer to have to sit out from the wall and if it is half an inch out too far the outside door hits it when opening and closing. The racks in the closets are not installed properly, they are not attached to the studs and the anchors have pulled out of the Sheetrock, and again poor design. The vent on the roof has been leaking for years, we have repaired it four times and it has leaked into the master closet causing mold. All the trim is different and not flush with the windows and just started falling off after a year. We were told there were no other options for carpet and were not told of the other available options that I have seen online since we had ours built. This has been a nightmare and we regret ever buying this home and will never buy another home from Clayton Homes. I wish they would refund us what we have paid and take this thing back so we could get a better home! And I agree with the class action, they should have to pay for all their crappy construction!

I purchased a used 2001 Clayton mobile home in 2010 from a
Individual and we recently went thru hurricane Michael in the Florida panhandle and I had issues like everyone else I had a contractor come out and replaced my roof with a metal one and he noticed that I had some vinyl siding missing so we had insurance company send adjusyout and underneath the vinyl was a cardboard looking material with no house wrap or plywood so now I’m fighting with insurance company to replace all my vinyl with plywood house wrap and also new upgraded siding because I have rotten molded mildewed walls around my whole house!!! Anyone else experiencing this problem? Someone stated there was a class action lawsuit against Clayton homes about this issue any information would be helpful!!! Thank you in advance!!!

Bought my Clayton Home in 2008. Was on the roof this weekend 3/23-24/2019 repairing leaks. The shingles where tearing and falling off. They did not put felt paper under the shingles. So now the roof sags between joist.

After reading all the comments I really don't have to much! We have the same problems. My roof is leaking through the smoke alarms, my floor has floor has soft spot, the trim is always falling off. The shower barley works.there's another soft spot in the master shower. Closet door keeps falling off in the spare room. Its is one of the cheapest made places I have ever seen in my life. No matter what you do in the kitchen the plug always blinks red. Master bath sinks are crooked and they don't care. Mine is just a little over 1 year old and falling apart!

My husband and I bought our Clayton home in 2012. We had a lot of things to fix once or was put on land that the office said they would send someone out to fix. The man did cover ups not fixing anything. We had several leaks behind walls. Under counter my husband had to fix those. The house is cheaply made with cheap parts. I wish we had had someone telling us not to buy from them. I have two small kids now and we stay sick. I really believe it’s from mold in the walls. Even the back door leaks when it rains.

My wheels and axles were taken off our mobile home. My roof sags. I called was told to repair it our self and they would pay what cost to fix. We brought our home in Conroe, Tx and live in Orange, Tx. No one ever returned to fix anything.

But my homeless in 6 months ago from kabco and Vidor Texas. The home manufacturer is Clayton Homes. I have been dealing with nothing the repairs since the day I bought this trailer. I have to deal with the manufacturer out of Tennessee in order to get any work done and they only seem to have one or two people that'll do it the work is still lingering the warranties half over and I still have a lot of issues that they have yet to repair it's always an excuse of why they can't come right away. The funny thing is there's a Clayton home dealer not even 6 blocks from me and they can't send anybody to repair things. The place is falling apart little by little uneven floors, uneven ceilings, doors warped daylight on back door. Locks don't work properly been out several time to fix them still having issues. Trim and molding everywhere doesn't match up or missing. Countertop in the kitchen all uneven repaired it but there still a little Gap they seem to think it's right but it's not. Microwave that doesn't seem to vent outside events inside and steams up the microwave exterior. Refrigerator ice maker is crooked and seems to work when it wants to. Very noisy. Outside of refrigerator has a little button thing on it they came off when I wiped it to clean. Bathroom sinks are not sealed. Shower head fell off while I was in the shower had to get a replace myself. Kitchen sink leaks they said they fixed it the first time they came out but apparently it still leaking has warped the bottom of the cabinet. External siding messed up in several places. Porch attachments or whatever they call them are loose broken or missing. Wall plugs came out when I pulled a plug out of it and several areas. AC is not working properly in the master bedroom. Windows are fogging up and they're double pane windows and shouldn't be doing that per the glass company. The list goes on but yet I have to wait to get it repaired I've sent numerous of emails spoke with him several times about getting my money back since I paid cash kabco refuses to give my money back and the manufacturer says they don't know who I talk to. I need help and don't know where to go. I think this is wrong to sell such a cheap made place and take somebody's cash and not reimburse them for when I have given them ample time to get this place fixed. They always have excuses. Help please

I bought my home and was charged for the wheels and axes they took back. I want to be party to the suit. I was never told I would pay for them and then they took them and the tongues back to Clayton.

How do we start a Class Action Suit against them if everyone here has the same issues, poor workmanship. Mine included, leaks, sagging roof, hard to open windows and doors, moulding falling off, doors leak when it rains, floor dips in spots, ....................need I say more. Their mobile homes are cheap shit.

Brought our Clayton Homes mobile home in 2016, was a 2015 model, cant even call it a home. There are so many problems with it, floor, moulding, leaks around door, trim around doors about half inch off wall door not closing. They came out after a year of calls checked level said it was level fixed some moulding in spots now other spots coming off, floor dips in spots, door leak around top when it rains yes comes into the house, I want to join the lawsuit if any against Clayton Homes. Phone calls go unreturned as well.

We purchased a modular home in 2015. W have been dealing with mold reoccurring, cheap materials. Appliances going bad, ceiling falling because a bucket of staples was left in it during installation. Constant battle. I see everyone else with same complaint. Cant we get a class action going based on that?

When call Home First about repairs on my Clayton Home . Home First stated it is because of the Mobile Home settle. I paid thousand to add brick boulders to avoid this.

Our Clayton Home was purchased from Mobile Homes of Houston located at 13110 South Freeway, Houston, TX in October 2016 and delivered in early December 2016. 9 days after delivery, a work crew, sub-contracted out by Mobile Home of Houston showed up to complete the interior of the home. We did a walk-thru check-list on December 28, 2016 and forwarded the information to Jennifer Avila at Mobile homes of Houston. Mobile Homes of Houston does not provide a professional check-list for home owners so hand written notes and pictures have to be taken. Jennifer Avila acknowledged the receipt of the emails on December 28, 2016 and said she had made a work order. We replied and said we would follow up with any additional things we found as we moved through the home more.
The first main concern and issue with the home was that there was no cold water in the kitchen. All other faucets were working correctly with that exception. We made several calls and sent multiple emails in regards to this particular issue. We had to wash dishes in the bathtub, rinse food and vegetables in the bathtub and go to the bathroom just to wash our hands while cooking or messing with items in the kitchen. 5 weeks passed from December 28, 2016 before the first “repair” crew, consisting of 2 young men, showed up to make repairs. With a phone call from Mobile Homes of Houston only giving us approximately 18 hours’ notice that they would be out, I, Mary Gibson, took a day off of work to be there at our home. That crew showed up with only a limited number of supplies and tools to do the repairs noted. They fixed 2 issues out of a check-list having nearly 20 unresolved issues. They blamed it on the yard and Jennifer for not ordering the correct materials.
After that, I made several attempts (dating back from) January 2017 to track down the parts that were supposedly ordered and make contact with the contractors and sub-contractors that are hired through Mobile Homes of Houston. I have been told to contact different employee’s within Mobile Homes of Houston, leave messages, and that the log of “repair requests” that Clayton Homes has on the books is large. Conversations with Jessica, Rex, Christina and Jose led to no resolution. AS of February 22, 2017, we were still waiting for a crew to come back to our home with the appropriate materials and make repairs.
On February 22, 2017, an email was sent to Jennifer Avila in regards to the ongoing wait. We waited a week for her reply which came back on February 28, 2017 and she noted she had been on vacation and did not have anyone apparently following up on urgent emails. The communication goes back and forth between Jennifer Avila and a lady named Christina in regards to who has the parts and orders them and etc. In her acknowledgement email, she said our parts were there at their lot and they were waiting for the contractor to pick them up and make his way to our house to make the repairs. A crew showed up again, I believe on March 2, 2017, at the last minute with less than 1 days’ notice to make the repairs. Again, they showed up with just a few things and were not able to complete the job. I had taken off another day of work to be there with them. The crew claimed they were not given the correct items, did not have the items on the list and did not have the materials and tools needed to fix other issues.
During all of these rescheduled trips and conversations, we were already told several times that the parts and materials had been ordered and were in. The Clayton Homes are built pretty standard with just a few choices available. This is even more confusing to us as to why it takes so long to order parts and materials for homes that are built with similarities and customary standards. So we waited again. On April 4, 2017, we received an email from Jennifer Avila saying that the parts were in and she would be sending a work order over to Alden. We waited 2 weeks and again, on April 20, 2017, I received a call telling me the work crew could be at our home the following morning. Again, another short notice for me to take another day off of work. The crew comes out on April 21, 2017 to fix the remaining issues. And as history has repeated itself with Mobile Homes of Houston, this work crew, who happens to be the same work crew that was out previously, shows up with no materials to complete the job. They attempted to fix one soft spot in our living room floor and not even that was repair professionally nor correct, as it is still there. They apologized and showed me their work order which only had a 2 or 3 things listed on it, that they did not show up with either way. They blamed it on the yard and Jennifer and claimed they were not given the correct items.
On May 2, we received a call from Mobile Homes of Houston saying all of the parts were in and they would be coming back out, again. I spoke to the sales manager Drex and made it very clear that I would not be taking off any more time from work for this issue unless every single part, item and material was on the work crew’s truck and all of the work would be completed that day. We went over the list of materials and issues left to be repair and Drex claimed to have no knowledge of some of them, therefore agreeing that not all of the parts were in. So I told them they would not be coming out until all of the parts were in. We could schedule then. Drex then called my husband and convinced my husband into letting them come out on Friday, May 5, 2017 to make the repairs. Drex told my husband, Joshua Gibson, that he promised that every single thing would be in and fixed that day. My husband told Drex that the only way they would be able to come out was in fact, if ALL of the materials were available and Drex acknowledged they were.
On Friday, May 20, 2017, we received a call saying the work crew would be there between 9:00 AM and 11:00 AM so I took another day off of work to wait for them. At 10:45 AM I contacted my husband to see if he had heard from the work crew by chance and he said they did call him at 10:35 AM and tell him they were about 30 minutes away. Late, and pushing the 2 hour window, I waited. I got the work crew’s phone number from my husband and contacted the crew who were on their way so we could go over what they had on their truck. The work crew, Matt, named 3 things and that was it. There were 7 at minimum to be fixed and they claimed they had no idea. Again, this is the SAME crew who had been out previously and was verbally told about the issues and they documented them in writing as well. When I was told they did not have everything, as promised, I told them they could move on to a different customer that day. I was going in to work and make up for lost wages.

We bought our home in 2004 paid 120,000 it is paid for. However when they did the pipes in our home 2 of the master bathrooms didn't have pipes for the toilet nor shower. I had a plumber to come out and they had to redo all of the plumbing. Since then just last year aline 2016 I have spent an addition 30 thousand dollars. The entire house was literally splitting in half which means the floors and walls were seperating. When they bought it here it was paid for i was debt free i feel they over charged for work they didn't do. They ought to be ashamed of themselves. You don't take advantage of people. And I don't have money to piss away to a company who should be held liable. And i don't have the wheels to my home either and we paid for them.

We purchased what we were told was a Modular Home from Clayton in 2007. We went to get it refinanced to obtain lower interest rates, however the bank said because it has a steel frame, it is considered a manufactured home not modular. All of our paperwork from Clayton states it is a modular home. Is there a current lawsuit against Clayton for this reason?

Clayton homes took axles and tires when trailor was set and also didn't set trailor on concrete pads just put blocks and now it has gaps between blocks I can't even move mobile home if I wanted to because no axles

I did not receive axels or wheels and it sickens me that we was pushed into signing our contract before the house was even completely set up. Our home was 54,000 on the lot no additional add in or take outs. I was told my payment would not be over 520 a month and when I get my first bill it was over 672 a month and now its over 800 a month with a fixed rate. My loan is right at 100,000.00 and to top it off the land was given to me as a gift from my mother in law. This year 2016 is when I am finding out how crooked Clayton homes is. and was makes it worse is we have had water leaks, doors not leveled to all the rooms (will not stay shut) had a pipe bust in which the flooring was not covered, I had to pay to get it replaced just a couple months after moving in. Nail studs coming out of the wall. Windows will not stay shut, paint stains every where. Trash upper under cabinets, we did not receive the appliances that was in the home or in our contract. the screen door was not screened in. and is still not screened. There are more issues. I have complaints a mile long and work orders on my home that the Maintenance guy signed off that he was going to fix all the issues but never did. I purchased my home back in 2008 and here it is 2016 and new issues keep arising. This was my first home.. OH AND I WAS TOLD THAT I WAS APPROVED FOR FIRST TIME HOME BUYERS PLAN.. I JUST FOUND OUT THIS YEAR THAT WAS NOT HOW MY LOAN WAS DRAWN UP... SO NOW WHAT DO I DO.. I CAN NOT AFFORD MY MORTAGE AND THE TWO PEOPLE THAT RIPPED ME OUT OF MY MONEY AND OUT OF A NICE HOME ARE NOW LONGER THERE THEY LEFT RIGHT AFTER MY LOAN WAS CLOSED ON... I FEEL STUPID AND RIPPED OFF.. WHAT DO I DO NOW?

Boight a clayton home in 2003..same issues as everybody else.. Cracks, mold, air went out, all appliances had to be replAced, im a widowed mom of 3, this company needs to be held reaponsible for whT they are doing to people.. I hope they understand that the word is getting out.. Do not buy a jouse from this company

we got our home in ringgold and cannot seem to get it fixed. the ceiling and walls have cracked several times ceilings have been fixed by caliver just hope they stay fixed since they have been repaired 3 times some cracks have been repaired in walls now have 2 different color paint floor at marriage line has about 2 inch gap where the house was not put together properly we have had so much trouble with this house bowed wall in living room ect ect no one seems to give a damn. it is a shame a company like clayton homes has a owner that does not care what kind of crap they sell you and the manager up at ringgold lot doesn't have any business being in charge of anything he is all for his bottom line once you buy the house you are on your own,that is why they want all their monies before you get the keys. would not suggest anyone to buy a home from these people,a bunch of crooks and liers especially the one in ringgold Georgia

I bought a piece of sh*t mobile home from Clayton also. Still owe more than it's worth. The floors and roof had to be fixed after only three years. The windows fell apart. Don't bother calling Home first insurance they don't cover anything. Can't wait to pay off this turn of a home so I can make it my mission to campaign against Clayton vanderbilt and Home first insurance. Please people listen to me they sell you defective homes. They literally fall apart. Poorly made. Awful. Seventy thousand dollars down the drain. I'll be lucky to get five thousand. They suck!

We purchased our home in Corinth, MS in Dec 2012. It was the worst mistake that we have ever made. B and K assisted us with our purchase and admittedly we were swayed by the customer service. Once we moved in we had some repairs that we called in. The first time they sent out a guy who was the nice gentleman and he mention a survey and how he hoped we would give him a good score. The second time H and some other guy came out. They also mentioned the survey and asked for a good score. Then Horace explained to us that if we didn’t give them a good score it would be very difficult to get someone else out to make repairs. We were shocked and didn’t know quite what to say or do. After all we still had ten months left on our warranty so this concerned us. When they got ready to leave H asked that when Clayton called, if we would lie and tell them he had made repairs that he hadn't done because they didn’t pay them enough to drive the distance to our home and it would help make up some money. The next time he came out he mentioned the survey again and he explained that if we didn’t give them a good score it would affect B’s pay as well as theirs. Plus, he reminded us that it would be really hard to get them out again for repairs. The coating on the kitchen cabinets starting peeling off, so I called B and he told me it had been recalled and he would make good on it. Well, I guess making good on it means they would cover it up in the places they could with molding (even though it was peeling in some places that the molding wouldn’t cover). Then a plug-in receptacle came out of the wall. When H came out he explained that it wasn’t made that well and I would need to hold them in place with my thumb or hand!!!! And when he repaired the plug-in I asked what was I supposed to do about the torn wall pattern outside of the plug-in. He informed me that it shouldn’t tear anymore! I now have a torn wall pattern to remind me of the wonderful service I have received! He then asked for me to lie to Clayton again, this happened every time he came out, it didn’t matter if it was fixing clogged pipes, molding or skirting, and several more plug-in receptacles that they never repaired. We mentioned this to B when he called us to discuss the survey! He told us he knew how much we loved to shop at Wal-Mart and if we would give them a good score, there would be a really big surprise in the mail for us (we are still waiting for this really big surprise)! They also put the tie-down piers in the wrong spots, the windows are cracked, all of our cabinets are peeling, the trim is still falling off the walls in every room where they didn't attach it, we have no water pressure in one of the bathrooms, (H said there must be an acorn stuck in the pipe), really? Did he repair it? NO! Saw dust blew out of all the vents for over a year and not just a light coating either. I will NEVER recommend Clayton to anyone and I will do my best to save anyone from purchasing from Clayton.

somehow Vanderbilt is on my mother's deed of trust. I was with her and witnessed her telling them she was not going to put her land up for this home. my mother bought this home from clayton mobile homes in Athens, tn in 2007. I have exact dates and a copy of the contract if needed. My mother has since passed away and I need to know what to do about at least keeping the land because as I remember they had no way of putting their name on the deed when my mother never had a copy of it, she only had a copy of my grandmother's will leaving the land to my mother. I got my home in 2006 I know I don't have axels or wheels but the worst part is bad mold in walls big crack in roof always having trouble with vmf I would like to see what we can get done about the poor quality over priced and high instrest. To the point I can't sell my house cause I owe to much can't let it go back cause of credit which is not on my credit anywhere and charged me over $7000 in back ins which is escrowed in payment tired charging me for flood insurance when my dead says not in a flood zone took all my saving to save house only reason I did then is I had three kids where I have 4 now and both my youngest boys had siezer already which can be side affect form mold
