Dan Frazier



A lawsuit seeking class action status has been filed against Dan Frazier of Flagstaff, AZ, alleging he is profiting from the names of soldiers who have been killed during the war in the Middle East. The suit, filed in a Tennessee federal court, claims Frazier, who owns the web site CarryaBigSticker.com, has no right to profit from commercial sale of products that use the dead soldiers' names without permission.

The web site sells T-shirts that say "Bush lied â€" They died" and lists the names of the fallen servicemen. Frazier claims he is protected by his right of free speech under the first amendment and is expected to request the lawsuit be transferred to the state of Arizona where he is challenging an Arizona law barring use of slain service members' names for commercial purposes without permission. The suit is seeking class action status on behalf of all heirs of the US soldiers who were killed in the Middle East since September 11, 2001, and seeks $40 billion in damages.
