Three class action lawsuits have been filed against insurance companies Traders General Insurance Company, Kingsway General Insurance Company and CIBC General Insurance Company/Certas Direct Insurance Company. The plaintiffs in the suits include car owners who held policies with these companies. The suit claims that the companies withheld the salvage obtained from cars which were written off as a total loss, but that they did not pay the owner the actual cash value of the car as they withheld the deductable. Those funds, which amount to $50 million dollars, should have been paid to the car owners according to the suit. The suit sites a case from June 2001 where the Ontario Court of Appeal ruled that car owner must be paid the actual cash value of their car, not the actual cash value less the deductible.
