A class action lawsuit has been filed against the company for allegedly failing to reimburse former employees for mandatory Wage Investment Plan contributions. The lawsuit was filed in Wake County Superior Court and claims Energy Conversion Systems wrongfully terminated some employees and failed to pay back loans.

Several years ago, Energy Conversion Systems asked employees to loan them money, which would be paid back in 2006. The mandatory payout was contingent on meeting certain objectives relative to the company's performance. Employees who continued to work for the company were paid back in April 2007. But former Energy Conversion Systems employees were never paid.
