Electronic Data Systems Corp.



A lawsuit has been filed and is seeking class action certification against the computer servicing company for allegedly failing to pay overtime to its employees. The lawsuit was filed in US District Court in Detroit on behalf of thousands of current and former Electronic Data Systems Corp. (EDS) workers. The complaint alleges EDS improperly labeled its technical service workers as exempt from overtime in violation of the federal Fair Labor Standards Act.

Employees were misclassified as exempt from overtime as they were not performing managerial duties. Technical service workers install software or hardware, maintain systems, fix bugs, do routine maintenance, and deal with user problems.
