Ford Faces Lemon Law Class Action Lawsuit

San Francisco, CA A class action lawsuit has been filed on behalf of all persons who purchased or leased a Ford vehicle in California and were charged for excessive damage and/or wear and tear when returning the vehicle pursuant to California' Lemon Law.

The lawsuit, entitled Sansoe et al., v. Ford Motor Company, Case No. 3:13-cv-05043-PJH, seeks to cease Ford' business practice of charging California vehicle owners and lessees, or requiring them to pay third parties, for excessive damage and/or wear and tear to lemon vehicles.

Under California' Lemon Law, when a car manufacturer repurchases or replaces a vehicle, it is prohibited from taking a deduction for use of the vehicle other than that specified in a statutory mileage formula. A car manufacturer violates the Lemon Law by charging an owner or lessee any amount for use of the vehicle other than the mileage formula. Plaintiffs are represented by Kaiser Gornick LLP.

I leased a 2015 Lincoln MKC 09/2014. The vehicle was supposingly BRAND NEW! I first incurred issues with the XM radio signal. I returned the car to the dealership in twice in October, 2014 for repairs. Again in November 2014 and each month after that until FINALLY the service advisor told me that ALL MKC was having the same problem and he needed to order a special part. I was able to receive a signal but later on the radio started going in and out. To add to the problem, the check engine light started coming on. I returned the vehicle approximately SIX times and they could not locate the problem. I went to the accounting office and ask how I could terminate the lease because I could NOT continue to drive and pay for a vehicle that was not dependable. I was driving ALONE and the car stopped on my way from Houston to Dallas. I have EVERY incident recorded on my cell phone. The car dealership(Bayway Lincoln, Houston, Tx) kept giving me the "runaround" about terminating the lease. In February, 2016, I had to take it or repairs because not only was the check engine light on-the car was hesitating. I took it into the service department and I just couldn't take it anymore and both the dealership and Lincoln Financial were ignoring me. I left the car at the dealership and said I would not take it back because they still had no idea what was wrong. Now Lincoln Financial is trying to sue me for $16,000, They have put a negative mark on my credit report that I had worked so hard to keep above 650.
Do I have any recourse?
