Homeowners whose mortgage loans were originated by GMAC Mortgage or whose mortgagees were assigned to GMAC Mortgage for servicing are complaining that this company failed to timely post payments, unfairly forced placed insurance, charged fees to which it is not entitled and otherwise failed to service these loans properly. Based upon its own errors, GMAC Mortgage is unfairly foreclosing on certain mortgages.

For more than a year now, I have been trying to straighten out a problem with GMAC Mortgage. They refuse payment on some months, or post the payment late, thereby charging me late fees, so that the automatic bank payment from my bank to GMAC by certified funds is said to be "non-sufficient" funds. Every month they call me at the end of the month to tell me that they have not received the payment. I have never spoken to the same person twice. I always get a supervisor on the phone. They guarantee to me over the phone that the matter has been straightened out, and the next month, it happens again! What can I do? Where can I go? I have spent hours trying to straighten this out; to no avail. They have received every payment due them, yet they claim we still owe them money. They add on "fees" continually. Please help me!

First, on two seperate occassions GMAC Mortgage attempted to place hazard insurance on our property when we had, and always have had this insurance in place. Mind you they are our secondary mortgage.

Second, for the past several months they have been claiming that we have missed two payments. There have been no missed payments, and we have the documentation to prove it.

Failed to notify us that they had our loan, had the incorrect mailing address, we did exactly what they asked us to do to 'settle' our past due account, not enough, now in foreclosure. They waited almost two months to call back after we asked them to investigate our account for errors. Now we are in foreclosure (Nov. 14)
