Go-Paks Underfilled, Class Action Lawsuit Claims

Santa Clara, CA: A consumer fraud class action lawsuit has been filed against the company behind "Go Paks", alleging the product packages contain non-functional slack fill.

Filed in San Francisco, by Anthony Bush, individually and for all others similarly situated, the suit claims that defendants Mondelez International Inc., and Mondelez Global LLC falsely and deceptively misrepresent the quantity of food contained in each unit of its "Go-Paks."

According to the complaint, the small, cup-sized Go-Paks, which contain such products as Oreos and Teddy Grahams, are packaged in a way that conceals the contents.

Bush claims that the containers are under-filled by 25 percent or more, however reasonable consumers believe they are purchasing a container full of the advertised product.

Bush and others in the class are represented by attorneys Ryan J. Clarkson and Shireen M. Clarkson of Clarkson Law Firm PC in Los Angeles. The case is US District Court for the Northern District of California Case number 3:16-CV-02460-JCS

Buy theses for my grandchildren. They are usually little over half filled most of the time and thought it could ne from settling. Apparently I was right when I felt they werent filled enough.

Purchased a small, cup-sized Oreo Go-Paks wsdvpackaged in a way that conceals the content. The containers are under-filled by 25 percent or more. However, I believed that I was purchasing a container full of the advertised product.

I have purchased several times for my grandson and thought the product was low due to settling and product shipping but I guess that wasn't the case .
