Martha Stewart Living and Kmart Corp.



A Washington State Superior Court Judge issued a ruling that has certified a nationwide consumer class action involving purchasers and users of "Martha Stewart Everyday" brand dinnerware. The glazed ceramic dinnerware, distributed and sold in over 1400 Kmart stores throughout the United States, bears a basket weave design and is marked "mse" on the bottom. According to the Class Action Complaint, this style of dinnerware is falsely labeled "microwave safe." The dinnerware in fact, according to the complaint, reacts to microwave radiation and becomes so extremely hot that a consumer will likely receive second degree burns when they attempt to remove the item from their microwave. The class action seeks an order directing that consumers be warned of this danger, that the product be recalled, and that consumers be reimbursed for the purchase price of their dinnerware. The lawsuit was filed by the Scott Law Group in Washington State.

I microwaved a Martha Stewart Everyday rectangular 2.75 quart glass container and light green plastic lid that indicated it was microwave safe. The lid was not, and is now ruined/warped. I expect the lid and/or complete dish and lid to be replaced, as I use this a lot and it is pretty useless without the lid. I was not burned by this.
