PPL Corp.



The Delaware Riverside Conservancy Inc. and local residents have filed a class action suit stating they have absolute right to be included in Pennsylvania's court case against PPL, alleging numerous violations of environmental and dam safety laws, specifically about 100 million gallons of contaminated water and fly ash into the Delaware River from the utility's Martins Creek power plant.

The class action complaint faulted PPL for not taking advantage of low river flows in the weeks after the spill to get more fly ash out of the river. Company efforts in the spill's wake focused on the land around the basin, the creek and the discharge area. The Department of Environmental Protection filed suit November 18, 2005 against PPL Generation LLC and PPL Martins Creek LLC for the Aug. 23 spill.
