A $400 million national class action lawsuit on behalf of surviving lesbian and gay spouses for the denial of survivor benefits under the Canada Pension Plan was launched against the Federal Government.

The lawsuit alleges that the Federal Government discriminates against same sex couples by denying surviving partners a survivor pension under the Canada Pension Plan unless their partners died on or after January 1, 1998.

This same restriction does not apply to opposite sex couples. The January 1, 1998 cut off date was imposed on a purely arbitrary basis and without any legal justification. The lawsuit also alleges that while the Federal Government and its agencies collect CPP contributions from all working Canadians regardless of their sexual orientation, it does not provide equal survivor benefits on that basis.
