A lawsuit has been filed and is seeking class action status claiming the discount retailer violated the federal Fair Labor Standards Act by refusing to pay overtime wages to assistant managers. The suit alleges ShopKo routinely hires people under the title of assistant manager for non-managerial duties, and then fails to pay them overtime. The discount retail store employs more than 25,000 people at more than 360 stores in 23 states.
