A class action lawsuit has been filed against Washington Mutual, Inc., which is the largest residential mortgage provider in the United States. The suit claims that the company has overcharged its customers tens of millions of dollars in unauthorized prepayment fees. The suit further alleges that the company knowingly charged these excess fees, and preyed on unsuspecting customers by charging fees which exceeded the amounts stipulated in mortgage contracts.

In particular it is alleged that Washington Mutual imposed a $60 fee to prepare a payoff/demand statement and a $10 fee to fax that statement to you or your closing agent when these charges are prohibited by the terms of Washington Mutual's own Note with you.

It is also alleged that Washington Mutual has assessed a prepayment penalty in excess of what is provided for in certain Washington Mutual Notes (principally by Washington Mutual's wholly owned subsidiary, Long Beach Mortgage Company).
