A $10 million wrongful imprisonment lawsuit filed in Washington County, Tennessee is seeking class action status for as many as 300 plaintiffs. The suit alleges that Washington County Sessions Court Judges John Kiener and Robert Lincoln, along with former Circuit Court Clerk Don Squibb and employees of the clerk's office took illegal actions against people who came before the general sessions court.

The lead counsel Scott Pratt claims that "what the sessions court judges were doing was over a period of time they had developed this illegal and unconstitutional practice of putting people in jail who could not or did not pay their court costs. They would issue an arrest warrant, sometimes when the person was in the courtroom, sometimes they would send the sheriff's department and go out to the house and arrest them. Nobody else in any court around here does that," Pratt said. "There are two different statutes in Tennessee on how to collect fines, and there's a statute that says you cannot imprison anybody for failure to pay court costs."
