$1.9M Settlement Reached Over Pharmavite False Ad Claims


This is a settlement for the lawsuit.

Santa Clara, CA: A $1.9 million settlement has been reached in a consumer fraud class action lawsuit pending against Pharmavite LLC. The suit alleged the supplement manufacturer wrongly labeld its Nature Made brand glucosamine products.

Specifically, the lawsuit, which has been going on for six years, alleged Pharmavite falsely claimed that its supplement TripleFlex, which contains glucosamine, chondroitin and a sulfur compound, improved joint health by “replenishing the body with key nutrients,” despite a lack of scientific evidence.

According to the terms of the settlement, all US residents who have bought the covered products since May 13, 2007, are eligible to receive a cash or product award.

Class members with a proof of purchase will receive a $25 refund per bottle of supplements for up to four bottles. Clas members without a proof purchase will receive $12.50 per bottle for up to four bottles, according to the settlement. Class members can apply for product awards as well.

The lead plaintiff, Lorean Barrera, will receive up to $10,000 as an incentive award.

The settlement also stipulates that Pharmavite must relabel its products to exclude any indication that glucosamine or chondroitin rebuild, renew or rejuvenate, but will not need to recall or relabel any products that have been distributed with old labels.

The case is Lorean Barrera v. Pharmavite LLC, case number 2:11-cv-04153, in the U.S. District Court for the Central District of California.
