$2.5M Settlement Agreed in Securitas Guard Vacation Pay Class Action Lawsuit


This is a settlement for the Employment lawsuit.

Santa Clara, CA: A $2.5 million settlement agreement has been reached in an unpaid vacation pay class action lawsuit filed by former and current security guards who allege Securitas Security Services USA Inc, violated federal and California labor law regarding its vacation pay policy.

The terms of the proposed agreement, if approved, would cover over 24,000 opt-in members across the country, and provide for a separate settlement class for anyone who worked for Securitas as security guards in California between October 28, 2009, and the present. To date, 24,281 people have opted into the class, according to court filings.

The lawsuit was filed by former Securitas guard Michael Deatrick filed in October 2013, alleging violations of the Fair Labor Standards Act and California state law. Specifically, the complaint alleged Securitas does not pay its guards for vacation, but rather pays them a lump sum each year as compensation for their vacation time.

Deatrick asserts in the suit that these payments are really a nondiscretionary retention bonus because it is based on the number of hours worked, isn't dependent on vacation taken and is not given to guards who leave before their anniversary. The guards say Securitas should include the bonus in overtime calculations under the FLSA.

The case is Michael Deatrick v. Securitas Security Services USA, Inc., case number 13-cv-05016, in the U.S. District Court for the Northern District of California.

Securitas declined to pay me my accumulated PTO when they lost the contract with the client that was awarded to another comapny.

I signed up for that class action suit, my co-workers got their settlement checks, I moved so I did not get my settlement check. How can I get my check?

What happened with settlement and settlement checks for Securitas Vacation Law Suite? Claim submitted online 2/27/15. I talked to someone on phone last year before settlement to give currant address, I now have moved back to Texas. Please track down check. We received post card in Feb of 2015, phone number listed says no longer in use. (1 800 760-4713) with an address of Securitas Lawsuit Administrator c/o Rust Consulting PO Box 1973 Faribault, MAN 55021-6169 but mail returned from this address. My husband work for Securitas from 1999 to 2012. Thank You

I worked for them for over 25 years in the energy field, through an entire decommisioning, when that was done they let me go because I was old and female and they kept the young guys..go figure...as a result, I lost my home and left the state..settlement my butt, I never got a dam thing

I applied to enter this law action suit and have move to another resident and did not get my check from the settlement so I'm tracking down my check to see whether it was sent to my old home address I don't care if it was five dollars due to me I want it because the many I worked for Securitas company.

Recieved my settlement check today Nov 5th 2016 in the amount of $15.29 after taxes from $22.71 award.

Just got my settlement check. $12.43. I wish I could say I was surprised but that's how all of the class action lawsuits I've been in were. Just pennies, and since there was so many employees involved, this is the result. I'm not complaining though, I like working for Securitas, there are pros and cons, but thankfully at my site the pros outweigh the cons!

Unfortunately the time to join the lawsuit has passed.

Settlement checks should be mailed out by October 31st.,2016.

The judge approved the settlement on 9/22/16.
Apparently he is signing off on it within the next two weeks.

How much we will get remains to be seen.

In los angles superior court april 2016 i was told that the class action lawsuit for non payments of breaks was disssolved and we have to get our own lawyers. a lawyler from los angles already interviewed me and we have lawyler representing the plantiffs is he going to help the plantiffs since the class action law suit was dissolved

It says right in the handbook if you leave prior to your anniversary date you will NOT be eligible for your vacation.
Most of the issues I am reading about are everything you should have known if you had read your handbooks as they tell you to do.
No company has the "perfect" utopia for work. This is a decent job and if you don't like it then go work at McDonalds or WalMart

We probably won't see a cent from this settlement. It was such a SMALL amount, that the lawyer's fee's will most likely take it all. So, Securitas sticks it to us, then the lawyer's do the same.

I was part of this law suite and I followed up for yrs. I was told it was still in the works and now I see its over and I have not heard anything at all!

Securitas isn't the ONLY company to ever give you your vacation pay on your anniversary lol... It is a ruse to deter people from actually taking time off. My anniversary is in January of all months and it is not time I want to take off but, I do allot myself time off in the Spring and actually take a vacation. Like it or not, save your money you get and then you won't be crying about it later. Learn how not to touch your vacation check and put it away like you never received it. Not hard to do that, just convince yourself it isn't there!
5 years with them and even though there has been bumps, still a good job and steady! What company is everyone happy all the time? I hear complaints about every job I have been on so, take it for what it is worth... Good luck to all of you that signed up for this sham. Ya'll are getting screwed by the attorney lol

I worked for securitas from 2000 - 2014 then they laid me off and said they would find a new post for me. A month later I was terminated. I was just wondering when I would hear anything about the lawsuit.

This so called settlement is a JOKE, if you look at what we guards are paid (10.00 per HR.) we should have been given 400.00 per week for each vacation time we where entitled to before tax's.

Securitas is laughing its self all the way to the bank!
2.5 million divided by 24,000+ gives each of us $104.00 before tax's and what about the lawyers share they will get what a third of that so that could mean even less for us a grand total of $69.44 before tax's.

This settlement is WRONG and should NOT be agreed to by us the employees whom should have the loudest voice in this matter.

I to am working for Securitas here in Indiana.
I have been denied my vacation (paid) for the last 3 years due to there not enough hours worked how ever if they had included over time worked I would have at least gotten 1 of those years as a paid 2 week vacation,
I hope that any money we get will at lease equal the vacation pay denied us with interest.

Yes iam sign up for the the law suite as well eather doe i live In Georgia. I was denied my last one when our post was closed down i work for securitias in 2005 to 2013 do to failure kidneys and for securitias to deny my last vaction check was heartbroken specially the financial burden i was in so If i can found out any info on the this i sure appreciate it thank you

I to worked for them for six years an it wasn't till almost after five years I even got a full two weeks vacation check. I to would like to know when we will be reimbursed the money they owe us. There we're times I would go two or three months without even having a day off the whole mandatory overtime or I would get fired an as all of us we all need a job so you would suck it up and do it. Plus so many times I was put in situations that I could of been hurt and they would tell me not my problem. I stayed for so long because I cared about our clients an they would even say the way we we're treated was not right when I left the company I gave a two weeks notice an my boss took it personal and very unprofessional towards my decision to better my life. The clients we're so upset and didn't want me to leave but they understood and we're proud they even threw me a going away party and he was invited but said he would not be there because it was very unprofessional he told them that I couldn't go either but they said that they wanted it. Needless to say I went an they said they can see why now I was leaving. I'm not saying everyone will have the same exspirence that I had I just hope that this will be a wake up call and they will start to appreciate their employees a little more.

So $2.5 mil spread out amongst 24,000+ people will barely be $100 a piece. That's not counting legal fees, and whether or not Mr. D gets a big chunk of it. As I learned while working for them, don't ever bet on Securitas to help you out.

Hi I'm on Washington and had a similar problem. I left Securitas in July of 2011 which was less then two months before my three year anniversary and they denied me my bonus.
