$28M Settlement Reached in Monitronics TCPA Multidistrict Litigation



Charleston, WV: Monitronics has agreed to pay $28 million to settle multidistrict litigation alleging it violated the Telephone Consumer protection Act (TCPA) by autodialing consumers regarding their home security systems.

Class members alleged Monitronics, which sells security alarm monitoring equipment, and several alarm manufacturers, of violating the TCPA by using automated telephone dialing systems and calling numbers listed on the Do Not Call Registry to promote security products from Monitronics and Honeywell. The class further claimed that Monitonics was vicariously liable for calls placed by its authorized dealers and their subdealers and vendors.

If granted final approval, the settlement would provide monetary damages to class members who, from May 2007 to the date the settlement is approved, received unsolicited and automated telephone calls from Monitronics. Each class member is expected to earn between $12 and $25, according to the settlement.

Notably, court documents state that this proposed settlement does not apply to the other defendants in the litigation, including Alliance Security Inc., UTC Fire & Security Inc., Honeywell or Alarm.com.

The case is Monitronics International Inc., Telephone Consumer Protection Act Litigation, case number 1:13-md-02493, in the U.S. District Court for the Northern District of West Virginia.

June 2018 Court issued final...judgement
Appeal filed (little wonder)
August 27 Judge issued stay of settlement
October 17 A check was made out for my portion of the settlement amount. No statement that the STAY has been rescinded.

So the BIG question is -- can I cash it?
Is the postcard a real check? Will I be committing myself to purchases of other services?

I think these little settlements should be re arranged and re-computed so as to give more money to the clients,

I spect receive over $10000. I am so sick of telemarketing calls. The lawyers have the make good sense. Good lock for plantiffs and attorneys.

Scum lawyers??? Not really, and I DON'T CARE!!! The real scum-bags here are the telemarketers who call and call and ... I am so SICK of telemarketing calls, that if the lawyers make themselves rich going after them, I say GO FOR IT!

We had ADT for several years and they never bothered us but gave us good service. When we did not need the protection, they fulfilled their obligation very well...no uneeded calls from them. Even while we had ADT we had a few calls from some security places but never harassed by any then or since. NOW I DO HAVE a complaint about a group calling themselves medical representing medicare and they constantly call with a different number each time using a local prefix. THEY SHOULD BE DISCIPLINED.

$12 to $25 for the plaintiffs, probably maybe 8 of that 28 million, while lawyers get the other $20 million! Class Actions lawsuits are only a racket to enrich wealthy attorneys!
