$8.25M Preliminary Settlement Approved in Trex Defective Decking Class Action Lawsuit

Seattle, WA: Preliminary court approval of an $8.25 million settlement has been granted in the class action pending against Trex Co. The lawsuit alleged that the nation' largest manufacturer of wood-alternative decking sold defective products.

Consumers filed a consolidated complaint on December 3, 2010, after many claimed that Trex's first-generation, non-shelled wood-plastic composite decking, railing, and fencing products were defective and prone to mold spotting and color variation. Consumers allege that Trex failed to compensate them for the defective product in violation of warranty and consumer protection laws.

The certified, nationwide class-action suit includes anyone in the US or its territories who own Trex decking, railing, or fencing built with Trex non-shelled products purchased between August 1, 2004 and August 27, 2013.

Trex will not replace product under warranty

What does one do if the contractor who build this very nice home went out of business during the recession? My decks have warped, cupped, chipped, stained and shrunk.These decks are extensive and only 9 yeras old. Trex stated they need receipts, etc. Is there a class action which applies to this situation?

allisclio2000@yahoo.com. We repeatedly contacted them. They told us new system two years ago then we didn’t have a dark enough receipt etc. we gave them the name of the supplier. Now here I sit with a brand new junk deck installed in 2008 and we can’t get them to be honest. We contacted them in 2012 but they said new system lost it all. I am beyond angry. I have a builder statement and the supplier. It was installed by one of their people.
