Cruise Lines and Marketing Company Settle TCPA Class Action Lawsuit

Santa Clara,CA: Carnival, Norwegian, and Royal Caribbean Resort cruise lines, in conjunction with Resort Marketing Group (RMG), have agreed to settle a Telephone Consumer protection Act (TCPA) class action lawsuit alleging they made illegal telemarketing calls to consumers offering promotions with those cruise lines.

The lawsuit was filed by plaintiff Philip Charvat who claims he received the pre-recorded cruise line telemarketing calls which allegedly offered promotions from Carnival, Norwegian, and Royal Caribbean cruise lines. He further claims that he never provided prior express written consent to receive these calls.

Without his consent, the lawsuit alleges, the defendant’s cruise line telemarketing violated the TCPA.

According to the settlement deal, a settlement fund worth between $7 million and $12.5 million will be created depending on the number of claims filed. This fund will cover payments to qualifying Class Members, an incentive award for Charvat, and other related costs.

Eligible class members include people who received pre-recorded telephone calls between July of 2009 and March of 2014 on their residential or cellular telephone lines initiated by RMG during which RMG offered a free cruise with Carnival, Royal Caribbean, or Norwegian cruise lines as a promotion.

The settlement agreement specifically limits Class Members to those persons whose phone numbers are listed in Resort Marketing Group’s database.

Eligible class members may receive a potential award of up to $900 per telephone number.

A final hearing is set for April 2018.

The case is Philip Charvat v. Resort Marketing Group Inc., et al., Case No. 1:12-cv-05746, in the U.S. District Court for the Northern District of Illinois

There is no way to provide proof for this. I don't even know what number to look up in my phone bill. This is ridiculous and the lawyer is making money

this is a very unfair class action suit. The lawyers are trying to weed out the people who are committing fraud yet those of us who are being 100% truthful cannot proved that we had these phone numbers between July 2009 - March 2014 (13 plus yrs ago) because AT&T nor Sprint have the means of going back that far and cannot print out a phone statement from that time period. This is not right. I will be contacting the Attorney General Office to have them investigate the attorneys for this case . They knew from day one that we consumers would be out of luck trying to produce proof of our numbers . Its a loop hole that they made to fall into. If the millions that file a claim cannot produce evidence on their end that's more money in the attorneys pockets. We should all come together and start a petition against this class action suit.

Hi, I received the calls as well and when I submitted my claim it was accepted since it was confirmed that my number was reached. Now, they are asking for proof. It has been so long ago, I don't know the phone numbers they used. Do you happen to have the numbers written down somewhere so I can look through my records and submit?

Now they want us to look the phone number from which the telemarketers called. WHAT ARE THE PHONE NUMBER SO THAT WE CAN LOOK UP THE REQUIRED INFORMATION AND SUBMIT IT BY MAY 1, 2018..

Anyone who has had there phone number changed beyond 24 months ago will be railroaded out of this settlement.

ATT cannot go beyond that point in there computers to provide you a bill to verify your old phone number for proof.

I have received several calls from recording and agents. Saying I won a cruise. I ask to be removed from there call list and the calls keep coming.

I've received several phone calls about free cruises and discount trips from a recorded line

I will get the calls all day and all night and when I blocked them number they will call back with different numbers using fraudulent call ID names.
I am tired of receiving robo or other marketing calls since I am on the do not call list.

Same problem. They keep calling. I have hospice here for my mother. I asked the person calling who is a telemarketer, why she thinks it is ok to violate my rights and break the law! She hung up but continues to call... I have to stop providing care for my mother, to answer the phone to these people who have no respect for others and the law...

Iam tired of recieving phone calls from companies saying i won a fabulous cruise or a trip to a place in florida that maybe someday I will.be able to go to! Lets stop tgese harasing phone callers!
