A judgment has been found in favor of the plaintiffs in a class action lawsuit filed by approximately 140,000 current and former employees against IBM. The suit alleged that the company's pension plan was adjusted twice since 1995 in a way that was discriminatory to older plan members by reducing their benefits as they age. I was forced to the cash balance pension plan from the traditional pension plan at IBM in 1999. They said I had to be 40 years old and have 20 years of service on June 30, 1999. I had 22 years of service and would have turned 40 September 4th, 1999. So apparently they forced me to the cash balance plan after robing 45% of my pension.
