On March 3, 2005 an ERISA fraud class action lawsuit was filed against the food manufacturer in the United States District Court for the Middle District of North Carolina. The lawsuit claimed Krispy Kreme breached duties with respect to the management and administration of the Krispy Kreme Doughnut Corporation Retirement Savings Plan 401k and the Krispy Kreme Profit Sharing Stock Ownership Plan. The company has agreed to pay a $4.75 million class action settlement. (May-15-06)
