Preliminary Settlement Reached in Checkers and Rally's Wage and Hour Class Action Lawsuit


This is a settlement for the Employment lawsuit.

Cincinnati, OH: A preliminary settlement has been reached in the wage and hour class action lawsuit brought on behalf of crew members and shift managers employed by Rally's and Checkers restaurants.

The case was filed in federal court in the Southern District of Ohio in 2012 and alleges that managers at Rally's and Checkers restaurants in Michigan, Ohio, Kentucky and Arkansas denied workers overtime and minimum wages by changing time records, working employees off the clock and putting them on extended off-the-clock breaks during which they were not allowed to leave the premises.

If approved, nearly 500 current and former workers will split a settlement fund of $500,000.00 according to a formula based on the job title and total weeks worked during the settlement period. Individual awards are expected to average between approximately $900 and $2,000.

The proposed settlement requires court approval, and attorney fees will be awarded by the court and paid separately if the settlement is approved.
