A settlement has been reached in the securities class action lawsuit filed on behalf of persons who held the Company's Series A Preferred Stock during the relevant class periods. There are six remaining federal class action complaints pending against the Company and certain of its current and former directors and officers in the United States District Court for the Southern District of California for alleged violations of federal securities laws.
