AB&C Group Inc.



A class action lawsuit has been filed against the bulk mailing company alleging unpaid wages to terminated employees. The lawsuit was filed in Berkeley County Circuit Court and claims AB&C Group failed to pay more than 400 employees within 72 hours of their discharge, in violation of the state Wage Payment and Collection Act. It alleges former employees are owed three weeks of back pay for time worked.

It is anticipated that AB&C Group and Blue Sky Brands will soon file for federal bankruptcy protection. The class action is seeking to obtain AB&C Group's payroll records before bankruptcy papers are filed so there are accurate records of what the employees are owed. If AB&C fails to pay all wages due, then they will owe liquidated damages, which are calculated as three times the amount of unpaid wages. The complaint claims employees are now owed wages, liquidated damages, statutory interest, as well as attorney fees and costs.
