Recently, credit card companies have been suing clients who have not paid their bills. One man claimed he did not pay his bill because it was sent to him in English, but his native language is Spanish, and therefore he claims to have been unable to understand the bill. Dallas County Judge D'Metria Benson denied a summary judgment to the credit card company because the defendant spoke Spanish and the documents sent by the credit card company were in English. The defendant would have lost the case based on a technicality, not on the merits of their case.
