Tri-State Chrysler Jeep and Smart Automotive Group



A class action lawsuit has been filed against the car dealership for allegedly misleading customers with advertisements for automobile discounts. The lawsuit, case number 07-C-2420, was filed in Kanawha Circuit Court against Tri-State Chrysler Jeep and Smart Automotive Group on behalf of all those who received a direct mail solicitation, which indicated they had won a contest that entitled them to $4,000 off any vehicle sold by the dealership.

The class action claims Tri-State's conduct is part of a pattern and practice of failing to disclose material and relevant facts about used vehicles in an effort to increase the resale value of those vehicles. The lawsuit was filed on behalf of all those who received a mailing solicitation within the last 10 years from Smart Automotive Group. The class seeks compensation for emotional and mental distress, loss of use, aggravation, anxiety, annoyance and inconvenience. It also seeks punitive damages for willful, wanton and reckless disregard for their legal rights.
