Drive Financial Services



The class action lawsuit states that Drive Financial Services, while attempting to collect debts, sent its customers a letter when they were late in payments. The letter, which was sent to approximately 2,500 Texans, pretended to be written by an attorney or a law firm and stated that wages would be garnished if payments were not forthcoming. The lawsuit claims Drive Financial violated the Federal Fair Debt Collection Practices Act and the Texas Debt Collection Act. By threatening to sue, Drive's letter was also a violation of consumer protection laws.

I had previously fallen behind on payments with my car through Drive Financial. I have been paying full monthly payment every two weeks and now i am current. They call my work repeatedly and threaten to reposes my car and contact my supervisor. I have been working with them and they still threaten during every unwanted phone call. I love my military career, and they continue to threaten it.

Drive Financial Services has resorted to calling my references when I have already made an agreement to payoff my past due amount. Even after I have my payments, they are still calling my references. I have specifically asked them not to do this but they continue to do so. Also, I have learned they agreed to my loan amount even when they knew the car was not worth it. So now I'm in an upside down loan because of that.

Drive sent me letters stating that they would garnish wages, if I did not submit payment as ordered, not to mention harassment and leaving personal information with third parties other than myself, telling my mom or anyone who listen that they would pick up my car, if I didnt pay them. Threatening me has made me very nervous, I still have the car, but they have asked me to borrow money or do what I needed to pay them. It is a very uncomfortable situation.

I arranged for Drive to debit my checking account on March 31, 2007. They instead tried to debit my account on March 19 and March 27 resulting in insufficient funds charges being applied to my checking account. When I complained about the charges, Drive told me to fax copies of the insufficient funds charges to them and they would give me credit for the charges. I faxed the account statement, but have yet to receive my credit. Instead they have started charging me late charges.

I gave $4000.00 down on a 2001 VW New Beetle. A week before my first payment was due I call the dealership to ask them where I was to send my first payment (there was no information on any of my paperwork). They told me not to do anything until I received something from the lender. Well I never received anything. Not a payment book, a paper bill or even a letter with the information I needed to make the payment. On June 21, 2007 a man showed up at my home to take my car. I asked him who the lender was. He informed me that it was Drive Financial. I asked him for their phone number. He didn't have it but did get it for me. When I called to ask them why I had never received a bill or even a letter they told me they didn't have to send me anything. The conversation turned very ugly. They accused me of stealing the car because I gave a bogus address, a PO Box. That is not true.
