Educational Testing Service



Class action status is being sought in a lawsuit filed against Educational Testing Service on behalf of 4,100 people who had taken, and passed, teacher certification exams. The company revealed this week that it had mistakenly given the failing grades to approximately 10% of the 40,000 people who have taken the test from January 2003 through April 2004. The suit alleges breach of contract and negligence in administering the tests, which were used to evaluate the skills of prospective teachers in 19 states, and claims that many people were delayed or prevented from getting jobs because of the error.
