A class action lawsuit has been filed against Empire HealthChoice, Inc. (now known as WellChoice, Inc.), by orthepedic surgeons from New York state. The suit claims that the doctors were not reimbursed for necessary medical procedures. The plaintiffs are contesting the company's policy of only compensating doctors for multiple procedures if multiple incisions are made, which the doctors contest claiming that because of medical advances, multiple procedures may now occur through only one incision to the patients, thereby decreasing the risk to the patient.
