Kmart Corp. & Martha Stewart Living Omnimedia Inc.

The suit is alleging defective Martha Stewart Everyday brand cups sold since 2000. The cups are falsely labeled as microwave safe when in fact the cups actually react to microwave radiation, quickly reaching dangerously high temperatures that burn consumers who attempt to remove the cup from the microwave. The class action seeks appropriate warning, refunds and individual awards for personal injury.
