A class action lawsuit has been filed on behalf of 72 residents of Burnett Creek, Tennessee against the city of Knoxville, Norfolk Southern Railway Co., Burnett Demolition & Salvage Co., S&ME Inc., The Development Corp. of Knox County, Barge Waggoner Sumner & Cannon Inc. and sinkhole owner Phil Reagan. The suit is seeking up to $256 million dollars in damages due to negligence on the part of the defendants in the handling of hazardous materials from an industrial site. As a result of this mishandling of toxic waste, the property values for the Burnett Creek area properties have dropped to a level of condemnation. The soil in the area has been tested and found to contain diesel fuel, arsenic, lead, polychlorinated biphenyls (PCBs) and other contaminants. The suit also alleges that the defendants violated six federal and state environmental laws, and the defendants may face criminal charges as well for these violations.
