Long Island Power Authority



A civil suit has been filed in State Supreme Court in Mineola charging Long Island Power Authority (LIPA) with unjust enrichment, deceptive trade practices and breach of contract. The lawsuit is seeking class action status and claims LIPA pushed non-fuel fees into its fuel-adjustment surcharges and avoided a rule mandating that the Public Service Commission review rate hikes over 2.5 percent. The lawsuit seeks injunctions to block existing and future surcharges. LIPA notes the increased surcharges are necessary to cover increased fuel costs. The lawsuit seeks to recover surcharges and rate hikes wrongfully taken from LIPA customers.
