British Airways

A lawsuit has been filed and is seeking class action status against the airline alleging negligence in lost and misplaced luggage. The lawsuit claims British Airways has lost 550,000 this year and that the company is suffering from a massive back log of missing luggage. It has the worst baggage loss rate of all European airlines in losing one bag for every 36 passengers.

The suit claims the airline has acted recklessly under the international Montreal Convention, and such behavior entitles passengers to be compensated for the value of their lost or damaged belongings; British Airways currently has a $1,500 cap on its reimbursements. Bags that have been lost for more than 21 days can be auctioned off; individual personal items are sold off to the highest bidder. The suit seeks to represent American British Air travelers who flew internationally between Sept. 5, 2005, and Sept. 5, 2007.

We flew BA from Morroco to Heathrow, with a connecting flight to JFK. We missed our connecting flight and flew standby on Dec 22, 2007. When we arrived, none of the 12 pieces of checked luggage arrived. Over the past week, 8 of the pieces arrived, but 4 are still missing. BA claims that the pieces must be at Heathrow, but they have given no indication of when those items will arrive, and have no system for communicating with the BA baggage department at Heathrow. The local BA JFK baggage department never answers the phone and does not return phone calls.

A piece of photographic equipment I had packed is broken from mishandling, all my clothing is soaked and covered in mold, my suitcase is damaged and I have replaced a great deal of clothing due to the two month delay of the suitcases arrival. In addition my entire trip to Rome was a waste, as I was unable to pursue my photographic work (the reason for my visit), creating tension with models and colleagues. I was unable to pursue any of my photographic work for two entire months.

Bicycle was checked in Heathrow T4 for flight to Lyon #362. I was flying in Business Class and checked in more than 2 hours ahead of time. Bicycle never arrived although 2nd piece of checked baggage did. Phone calls to lost baggage went unanswered. Website with status showed nothing. I visited the Lyon airport 3 more times to speak with baggage representative. My 3 week cycling holiday that I had planned for nearly a year was ruined. Most recently (Sept. 13), I received a voice mail message from BA saying they may have found my bag. It may have arrived in Phoenix last night. I have already filed a claim with BA for cost related to delay of baggage and with my insurance here to get the bicycle replaced. Contents were worth in excess of $7000 (replacement cost).

Great emotional stress as two of the family members were 80 years old and had only two days of their medications packed in a carry-on. Which should have been adequate!
Emotional dissapointment for hoping to give the elderly members of the family a memorable and pleasant trip to the land of their heritage. Emotional stress form needing to check on the baggage daily.

Monetary damage for needing to replace clothing and personal items for four family members in a country with a very unfavorable exchange rate.

Change in vacation itinerary as we did not have proper attire to dine and attend several planned events.

The loss of every family members luggage is completely unacceptable. British Airways is in the business of travel, a major part of this business is keeping people's belongings with them! The issue is very personal, your things are personal and treasued. They absolutely did not care about the level of emotional conflict they were causing. Unacceptable! to say the least.
