A class action lawsuit has been filed against the city and state of New York for allegedly failing to comply with federal and state laws mandating the provision of services to protect adults from harm. The class action was filed in the United States District Court for the Southern District of New York, on behalf of New York City's most vulnerable mentally and physically disabled adults. The suit targets the City's Adult Protective Services (APS) program, which is responsible for protecting adults who, because of a physical or mental impairment, are unable to care for themselves and who have no one willing or able to assist them. The lawsuit was filed on behalf of all current and future APS clients who are not receiving or will not receive the protective services to which they are legally entitled.

I have an elderly tenant who is incapacitated mentally. Her physical and mental state have deteriorated to the point her living conditions are parallel to living in a garbage dumpster. I have contacted APS one year ago December 2015. The system is failing her. My fear is she is going to be found dead from her own neglect. Aps is dragging their feet in moving forward with article 81. I need to get before a Supreme Court judge. She needs to be removed and put into assisted living. How can I take my case before a judge to get this woman help. This is taking far too long with APS. Something is not right. Please advise. This case is desperate.
