A certified class action lawsuit has been filed alleging unpaid overtime and underpaid wages. The lawsuit was filed in the United States District Court for the Northern District of Texas on behalf of all current and former employees of Texas Apartment Locators. The suit affects leasing agents in Austin, Dallas, Houston, and San Antonio who have worked for the company since 1972.
The class action alleges some employees were misclassified as independent contractors. They were hired to perform work and should have been paid for every hour they spent working. Instead, these employees were paid by commission and during slow weeks they were not making enough to meet minimum wage requirements.
