Originally filed in 2000, the suit claims that long-term care insurance premiums more than quadrupled from 1982 to 2000, and that the insurance company had failed to disclose the "known risk of premium increases."

The case initially was dismissed in November 2000, but this decision was reversed in August 2001, and in April 2002, Cynthia Rothe-Seeger, U.S. District Judge, certified the case as a class action suit.

Lawyers representing a class action lawsuit are seeking more potential members for the suit and have sent notices to more than 9,000 North Dakota nursing home insurance policyholders.
