University of Phoenix

The US Equal Employment Opportunity Commission has filed a lawsuit and is seeking class action status accusing the University of Phoenix of discriminating against non-Mormon employees. The legal action claims employment conditions at the private college were less favorable for those workers in regard to enrollment leads, tuition waiver grants and reprimands. The suit alleges the University of Phoenix discriminated against its employees based on religion.

I work for the University of Phoenix as an Academic Counselor. I am 51 years old and I have neurofibromatosis, which can be (and in my case is) a debilitating and disfiguring disease. I believe I have been discriminated on the basis of age and my disability.

Each Academic Counselor is assigned a number of students to service. In our job performance we are heavily graded on our retention of these students called teams. Periodically, our teams will be re-arranged for various reasons. After these re-arrangements I am continually assigned “teams” that already have low retention, thereby effecting my employee evaluation. Other people in my age bracket have notices this same pattern. People in a younger bracket are assigned teams that already have a higher retention. Occasionally a student that has already dropped (thereby lower the retention for the team) will be taken from one team and put on another persons team. It usually goes from a younger person to an older person. We are never given a specific reason for this. There are other instances of discrimination as well, however this is this most blatant.
