Employees filed two class action lawsuits against the company regarding 401k stock losses during the 2000-2001 energy trade controversy. CMS has agreed to pay a $28 million class action settlement to the employees and their beneficiaries for alleged losses and will also pay any legal fees and expenses awarded to the plaintiffs' attorneys.
